Petition To Congress To Legislate The National Protect The Children First Law

Here are some important facts that I first want to bring to your attention:

Of released sex offenders who allegedly committed another sex crime, 40% perpetrated the new offense within a year or less from their prison discharge. Bureau of Justice Statistics

In 1996, President Clinton signed Megan's Law, which requires each state to notify the public when dangerous sex offenders are residing in their area.

The Prevalence and Consequences of Child Victimization: Summary of a Research Study (NIJ, 1997) Among the findings: 1.8 million of the 22.3 million U.S. adolescents (ages 12-17) have been victims of a serious sexual assault.

People have become so afraid, that they are willing to pay a convicted sex offender to move out of their neighborhood! The convicted sex offender has agreed to the price of $405,000.00! No deal has been made yet, but these people are serious!

On March 21st, 2005, Congress passed emergency legislation to protect one woman, Terry Shiavo.

On March 19th, 2005, three weeks after her disappearance, police found the body of little 9-year-old Jessica Lunsford, 150 yards from the home where she lived. Jessica was abducted and murdered by a convicted sex offender who was staying with his sister without the knowledge of the authorities. Under the terms of his release from prison, as a convicted sex offender, he was suppose to register his place of residence. He failed to do so, and no one had any idea that he was living next to Jessica’s family.

Martha Stewart committed the crime of lying to investigators during an insider trading investigation. She had no previous criminal history. She served five months in prison. Martha Stewart did not physically injure another human being. Still, under the terms of her release, when she left prison, she was under house arrest, and had to wear an electronic ankle bracelet.

In honor of Jessica Marie Lunsford who was abducted and murdered in Florida by a convicted sex offender,  and other child victims of violent sex crimes, we the undersigned, ask that Congress act now to protect our children. We hereby petition Congress to legislate the Protect The Children First Law. This law would mandate that any convicted sex offender whose victims are under the age of 16, wear an electronic tracking system or GPS, either in the form of an implanted chip, or an electronic ankle bracelet upon his release from custody.

The length of time that said offender is mandated to wear the monitoring device, shall be determined by his previous criminal history, and the undeniable likelihood that he will commit another crime. If said offender has three previous violent sexual offenses, a permanent electronic monitoring device or GPS, shall be mandatory, if he is released from incarceration.

If the convicted offender refuses, they shall remain incarcerated until they are deemed no longer a danger to society, by a review board of concerned citizens, a criminal psychologist, and the proper penal system authorities.

Any further unlawful sexual contact with a child under 18, by a convicted sex offender, would thus constitute mandatory revocation of probation, and life in prison, without the chance for parole.

In addition, we ask that these repeat sex offenders who prey on children, are not afforded the right to plea bargain to a lesser sentence.

It is apparent that present laws do not deter these repeat offenders from further crimes. Requiring convicted sex offenders to register their address with local authorities is no guarantee that our children will be safe from these offenders. Too many do not register. This law would at least give us some sense of fairness and protection in this matter.

Richard Nimer, the director of business development for Pro Tech Monitoring in Tallahassee, Fla.,  has a contract to operate a similar system in Florida and other states. Nimer spent 20 years in the Florida Department of Corrections and started that state's GPS program. ''It's been very effective in Florida and a number of states,'' Nimer said. ''It's decreased recidivism, and there's been fewer new felonies. The device makes offenders think twice before doing something that could send them back to jail.”.

We, as concerned parents, grandparents and citizens, must act now to protect our children from repeat sex offenders who pose a serious threat to our children, and too often, commit more acts of violence when they are released from our prisons.

Most of us know the names of many notorious killers, however, it is quite likely that we could name only a very few of their victims. To forget them is heartbreaking, especially for their families.
